Digital overhaul of OCI framework

The Ministry of Home Affairs on Thursday notified the Citizenship (Amendment) Rules, 2026, fundamentally restructuring the Overseas Citizen of India (OCI) regime and related citizenship procedures. The amendments, which take effect immediately, replace decades-old paper-based processes with a fully digital system. Under the revised rules, all applications for OCI cardholder status under Section 7A of the Citizenship Act, 1955 must be filed exclusively through the designated online portal ociservices.gov.in. The previous requirement to submit documents 'in duplicate' has been scrapped. The government will maintain the official register of OCI holders electronically.

New restrictions on minor children's passports

A significant new provision inserted into Rule 3 of the Citizenship Rules explicitly states that a minor child holding an Indian passport cannot simultaneously hold the passport of any other country 'at any time'. The phrase 'at any time' has been added afresh, closing a potential loophole. Applicants for citizenship on behalf of minor children born abroad must now formally acknowledge this condition. The earlier rule only required a declaration that the child 'does not hold' another passport at the time of application. The change imposes a continuing obligation throughout the child's minority.

Electronic OCI and biometric consent

The amendments introduce electronic OCI (e-OCI) registration, allowing cardholders to receive either a physical card or a purely digital credential. If a physical card is not returned upon notice, the government may similarly direct it to be treated as cancelled.
